Terms
& Conditions - Nicholsons Landscaping Division
- Upon
completion of the works, the responsibility for the
well-being of the plants will be passed to the Client.
- Any
planting out-of-season, upon request of the Client,
will be the responsibility of the Client.
- Unless
specifically mentioned, the quotation for the works
does not include for any watering. This will be the
sole responsibility for the Client.
- A
supply of water shall be made available free of charge
to Nicholson Nurseries for the use and requirement
of the landscaping works being undertaken.
- The
condition of any plants requested to be salvaged and
replanted shall be the responsibility of the Client.
- Newly
laid turf and seed may be subject to slumping after
laying. This is unforeseeable and is not Nicholson
Nurseries responsibility.
- Any
complaints regarding the quality of the plants, materials
or workmanship should be made as soon as possible
and will be considered only if made within 7 days
of completion of the contract.
- Once
an order has been placed either verbally or in writing,
we will only accept cancellation at our discretion.
- Quotations
shall be valid for a period of 30 days, after which
the company reserves the right of withdrawal or modification.
- All
additional work to that stated in our quotation will
be charged at our current rates and will be paid in
addition to the agreed contract price. Work of this
nature will not be undertaken without the Client’s
written consent if work is not already commenced on
site - in the later case - verbal agreement only will
be sought.
- All
work may be subject to re-measurement on completion.
Where required remedial work will be charged on day
rate unless covered by a provisional sum elsewhere.
- No
work will be executed on site involving cement or
mortar of any kind at temperatures less than minus
1 degree centigrade.
- Payment
is due within 28 days of invoice unless stated otherwise
in writing. Thereafter a late payment surcharge of
10% is payable.
- All
prices are exclusive of VAT.
- Any
goods (plants and materials) remain the property of
Nicholson Nurseries until their full price has been
paid. However, all liability for the goods shall pass
to the client on receipt of the goods.
- You
will be asked regarding location of services. If limited
information is available, CAT scanners will be used
and every effort will be made to safeguard your property,
but ultimately if damage is caused through accidentally
damaging services that had not been identified by
yourselves, then it will be your responsibility.
- Nicholson
Nurseries operates its own Health and Safety policy.
- Nicholson
Nurseries is insured against Employers liability and
Public liability risks.
- Nicholsons
reserve the right to substitute plants where the specified
plant is not available, or to omit them altogether
and deduct the cost from the final bill.
